Google must turn over foreign mails: US court

A US judge has ordered Google to comply with search warrants seeking customer emails stored outside the United States, diverging from a federal appeals court that reached the opposite conclusion in a similar case involving Microsoft Corp (MSFT.O). US Magistrate Judge Thomas Rueter in Philadelphia ruled on Friday that transferring emails from a foreign server so FBI agents could review them locally as part of a domestic fraud probe did not qualify as a seizure. The judge said this was because there was "no meaningful interference" with the account holder's "possessory interest" in the data sought. "Though the retrieval of the electronic data by Google from its multiple data centers abroad has the potential for an invasion of privacy, the actual infringement of privacy occurs at the time of disclosure in the United States," Rueter wrote. Google, a unit of Mountain View, California-based Alphabet Inc (GOOGL.O), said in a statement on Saturday: "The magistrate in this case departed from precedent, and we plan to appeal the decision. We will continue to push back on overbroad warrants." The ruling came less than seven months after the 2nd US Circuit Court of Appeals in New York said Microsoft could not be forced to turn over emails stored on a server in Dublin, Ireland that US investigators sought in a narcotics case. That decision last July 14 was welcomed by dozens of technology and media companies, privacy advocates, and both the American Civil Liberties Union and US Chamber of Commerce. On Jan 24, the same appeals court voted not to revisit the decision. The four dissenting judges called on the US Supreme Court or Congress to reverse it, saying the decision hurt law enforcement and raised national security concerns. Both cases involved warrants issued under the Stored Communications Act, a 1986 federal law that many technology companies and privacy advocates consider outdated. In court papers, Google said it sometimes breaks up emails into pieces to improve its network's performance, and did not necessarily know where particular emails might be stored. Relying on the Microsoft decision, Google said it believed it had complied with the warrants it received, by turning over data it knew were stored in the United States. Google receives more than 25,000 requests annually from US authorities for disclosures of user data in criminal matters, according to Rueter's ruling. Suranjit’s last rites Monday

The last rites for veteran politician Suranjit Sengupta will be held at his ancestral home in Sunamganj’s Derai on Monday. The Awami League Advisory Council member had been one of the youngest members of the Provincial Assembly and represented his party in almost every Parliament in the four decades since Bangladesh’s independence, reports bdnews24.com. He passed away while under treatment at Dhaka’s Labaid Hospital on Sunday. The body of the political leader has been taken to his home in Jigatala, his personal assistant Quamrul Haque said. At 12pm on Sunday the body will be taken to Dhakeswari Temple and then to the Parliament premises at 3pm. It would be taken to the parliament for lawmakers to pay their last respect, said Awami League General Secretary and Minister of Roads and Transport Obaidul Quader. The body will be taken to Sylhet by helicopter on Monday morning. It will arrive at his ancestral home at 10am. The last rites are scheduled for 3pm. Suranjit Sengupta was born in 1946 in Anwarapur in Sunamganj. After completing his undergraduate and postgraduate degrees at Dhaka University he completed his LLB at Central Law College and entered the legal profession. The minister was also the chairman of the parliamentary standing committee on law, justice and parliamentary affairs ministry and a member of the Supreme Court Bar Council.  ....

Bayern held but extend lead as Leipzig lose

Bayern Munich extended their lead at the top of the Bundesliga despite being held by Schalke, as title rivals RB Leipzig lost 1-0 at Borussia Dortmund on Saturday. Bayern, who are now four points clear, led when Robert Lewandowski chipped keeper Ralf Fahrmann. But Naldo levelled when he drove home following a short Schalke free-kick. Schalke handed a debut, against his parent club, to loanee centre-back Holger Badstuber, who has spent his whole career to date with Bayern. The Germany international, who has had an injury-plagued career, came off with a thigh problem but his new club said it was just precautionary. Leipzig failed to take advantage of Bayern dropping points when they were beaten 1-0 by Borussia Dortmund - who move up to third. Pierre-Emerick Aubameyang headed home the only goal after some great wing work from Ousmane Dembele. Leipzig thought they had equalised in injury time when Federico Palacios Martinez fired home but it was ruled out for a marginal offside; according to BBC.....

Ruthless Chelsea overpower Arsenal to stretch lead

Chelsea moved another step towards regaining the Premier League title with a 3-1 drubbing of Arsenal in the table-topping London derby at Stamford Bridge on Saturday as only Tottenham Hotspur maintained their distant pursuit of the leaders. Antonio Conte's side moved 12 points clear of Arsenal with a performance decorated by one of the goals of the season, a dazzling individual effort from Eden Hazard starting from near the halfway line. The 2015 champions' command at the top of the table was strengthened further with fourth-placed Liverpool falling 13 points adrift after their wretched 2017 continued with a shock 2-0 defeat at resurgent Hull City. Only second-placed Spurs, the one team to have defeated Chelsea in their last 17 matches in all competitions, appear up for the fight, reducing the gap at the top to nine points with their 1-0 win over Middlesbrough in the day's late match. Hull's win over Liverpool saw them clamber up one place to 18th in the relegation zone while another startling result featured Crystal Palace, who lost 4-0 at home to bottom club Sunderland, with all the goals coming in the first half. Conte was a satisfied man as he watched Chelsea avenge their worst defeat of the season in September at the Emirates, the 3-0 reverse that prompted him to change their tactical approach. The Blues have never looked back since and an early header from Marcos Alonso, the dazzling second-half solo goal from Hazard and a poor clearance from Petr Cech that allowed Cesc Fabregas to chip into an unguarded net in the dying minutes sealed their revenge. Hazard's goal was, by his own admission, "beautiful". The Belgian picked up the ball just inside his own half, swerved away from Laurent Koscielny, outmuscled Francis Coquelin and turned Koscielny inside out again before beating Cech from close range. Olivier Giroud earned a stoppage-time consolation goal but a fourth defeat in nine league matches effectively ended Arsenal's title hopes for another season as they now lie third on 47 points, after 24 games, to Chelsea's 59. "It was an important game. I consider Arsenal one of the six teams that can fight for the title until the end of the season. To put them 12 points behind is very important for us," said Conte, after presiding over a 14th home win in 15 games at Stamford Bridge. "In every session they show me great attitude and great will to fight and win this league." Stocks witness see-saw movement

The Dhaka Stock Exchange (DSE) and Chittagong Stock Exchange (CSE) witnessed volatile trading in early hours on Sunday as investors were active in both sides of trading fence. The market started with a positive trend and the key index of the premier bourse rose 12 points within first 5 minutes. But in next 10 minutes, it fell sharply by 46 points. After 30 minutes of trading, the key index of the country’s prime bourse advanced 2.80 points while the Selective Category Index of port city bourse lost 16.58 points when the report was filed at 10:45am. After volatility, DSEX went up by 2.80 points or 0.05 per cent to stand at 5,367.93 points when the report was filed at 11:00am. The two other indices also saw positive trend till then. The DS30 index, comprising blue chips advanced 2.49 points or 0.13 per cent to stand at 1959.38 points. The DSE Shariah Index (DSES) gained 2.09 points or 0.16 per cent to reach at 1,256.89 points. Turnover, the crucial indicator of the market, stands at Tk 972 million on the DSE, when the report was filed at 11:00am. Of the issues traded till then, 124 advanced, 98 declined and 40 issues remained unchanged till 11:00am. Beximco dominated the turnover chart with shares worth Tk 58 million changing hands till then, closely followed by LankaBangla Tk 53 million, Saif Powertec Tk 50 million, Islami Bank Tk 48 million and Appollo Ispat Tk 39 million. However, the port city bourse, the Chittagong Stock Exchange (CSE), saw negative trend till then with its Selective Category Index – CSCX – falling 16.58 points to stand at 10,047.06 points, also at 11:00am.
